Acceptable Use Policy

This Acceptable Use Policy governs the use of the services provided by Aubrium Technologies L.L.C ("Aubrium"). It forms part of the Terms of Use and is incorporated into them by reference. Capitalised terms which are not defined in this Policy have the meanings given to them in the Terms of Use.

1. Scope

1.1 This Policy applies to every person who accesses or uses the Services, whether or not registered, and to all activity conducted through an Account, including activity by any person to whom the Account holder has granted access.

1.2 The Account holder is responsible for ensuring that every person accessing the Services through its Account complies with this Policy, and is liable for their acts and omissions as if they were its own.

1.3 Where the terms of a Social Platform impose a restriction more restrictive than this Policy, that restriction applies to the User's conduct in addition to this Policy.

1.4 This Policy is not exhaustive. Conduct not expressly described may nevertheless constitute a breach where it is inconsistent with the purpose of this Policy as described in clause 2.

2. Purpose

2.1 The purpose of this Policy is to preserve the integrity, security, availability and lawfulness of the Services; to prevent misuse which would harm Aubrium, its users, its service providers or any third party; and to ensure compliance with applicable law, with the terms of the Social Platforms with which the Services interoperate, and with the requirements of payment schemes and providers.

3. General obligations

3.1 The User must use the Services lawfully, in good faith, and in accordance with applicable law and with the terms of each Social Platform to which its use relates.

3.2 The User must use the Services only in respect of accounts and content which it owns or in respect of which it is duly authorised to act.

3.3 The User must not use the Services in any manner which damages, disables, overburdens or impairs them, or which interferes with the use of the Services by any other person.

3.4 The User must provide accurate information to Aubrium and must not misrepresent its identity, its location, its entity status or its entitlement to act.

3.5 The User must cooperate with any reasonable enquiry made by Aubrium in connection with compliance with this Policy.

4. Fraud, payment abuse and misrepresentation

4.1 The User must not: (a) effect or attempt any fraudulent transaction; (b) use a payment instrument which it is not authorised to use; (c) engage in card testing or any activity intended to identify valid payment credentials; (d) initiate a dispute or chargeback in respect of a service received without first contacting Aubrium; (e) provide false, misleading or incomplete information to Aubrium, including as to identity, entity status, location or entitlement to act; (f) use a proxy, virtual private network or comparable means to misrepresent its jurisdiction or to evade a geographic restriction; (g) structure payments or Accounts so as to evade a limit, a verification requirement or a screening control; (h) exploit rather than report an error in pricing, in the grant of credit, or in the operation of a refund; (i) impersonate any person or entity, or misrepresent an affiliation with any person or entity, including with Aubrium; (j) use the Services in connection with money laundering, terrorist financing, or any transaction prohibited by sanctions law; or (k) repeatedly add funds to the Balance and request their return without obtaining the Services.

5. Platform and system abuse

5.1 The User must not: (a) circumvent or attempt to circumvent any safeguard, usage limit, quota, entitlement check, authentication mechanism or other technical restriction; (b) probe, scan or test the vulnerability of the Services, or breach or attempt to breach any security or authentication measure, except as expressly authorised in writing by Aubrium; (c) access the Services by automated means, or scrape, crawl, index or harvest data from them, except through an interface provided by Aubrium for that purpose; (d) reverse engineer, decompile or disassemble the Services, or attempt to derive their source code, structure, prompts, model configuration or analytical logic; (e) introduce any virus, worm, malicious code or other harmful component; (f) impose an unreasonable or disproportionate load upon the Services or upon the systems of Aubrium's providers; (g) share, rent, lend, sell or otherwise transfer access to an Account; (h) maintain more than one Account unless Aubrium has agreed otherwise in writing; (i) access or attempt to access data belonging to another user; or (j) use the Services to develop, train or improve a product or service which competes with the Services.

5.2 A person wishing to conduct security research in respect of the Services must obtain Aubrium's prior written authorisation and must comply with any conditions imposed. Testing conducted without authorisation is a breach of this Policy irrespective of intent.

6. Prohibited content

6.1 The User must not submit, publish, transmit, generate, host or link to content which: (a) is unlawful, or which promotes or facilitates unlawful activity; (b) sexually exploits, endangers or sexualises a minor in any manner; (c) is pornographic or sexually explicit, or advertises adult services; (d) depicts or glorifies violence, self-harm, suicide or disordered eating; (e) harasses, bullies, threatens or defames any person, or incites hatred, discrimination or violence against a person or group by reference to a protected characteristic; (f) infringes copyright, trade mark, design right, database right or any other intellectual property right; (g) discloses the personal information of another person without lawful basis, or publishes intimate images without consent; (h) impersonates a person or entity, or falsely implies affiliation, endorsement or sponsorship; (i) is designed to deceive, including phishing pages, fraudulent stores, fabricated offers, counterfeit goods, fabricated credentials and fabricated reviews or testimonials; (j) promotes a financial product or scheme deceptively, including any representation of guaranteed return, any pyramid or matrix scheme, and any unlicensed investment or trading service; (k) contains or links to malicious software; (l) presents medical, legal or financial advice as authoritative in the absence of the requisite qualification; or (m) is otherwise objectionable such that its association with the Services would expose Aubrium or its providers to legal, regulatory or reputational risk.

7. Restricted categories

7.1 Aubrium does not provide the Services in connection with, and the User must not use the Services in connection with, the following: adult content and adult services; illegal drugs and controlled substances; weapons, ammunition and explosives; gambling, betting and lotteries; counterfeit goods and pirated media; pyramid, matrix and comparable recruitment schemes; the sale of social media accounts, followers, engagement or audience metrics; and hacking, credential, spyware and surveillance services.

7.2 The following categories require Aubrium's prior written approval: alcohol, tobacco, vaping and nicotine products; regulated cannabis and cannabidiol products; regulated financial services, brokerage and lending; cryptocurrency and digital asset services; dietary supplements and products making a health claim; pharmaceuticals, telehealth and medical devices; political advertising and issue campaigning; and debt relief, credit repair and immigration services.

7.3 Aubrium may amend the categories in clauses 7.1 and 7.2, including in order to reflect a requirement imposed by a payment provider or scheme. An amendment takes effect on publication, and Aubrium may require the User to cease a use which has become restricted.

8. Orders and campaigns

8.1 The User must not place an order in respect of content which it does not own or in respect of which it is not duly authorised to act.

8.2 Content which is the subject of an order must be publicly accessible, must remain publicly accessible for the duration of the order, and must comply with this Policy and with the terms of the relevant Social Platform.

8.3 The User must not place an order in respect of content which is the subject of a subsisting complaint or claim as to ownership, infringement or lawfulness.

8.4 The User must not use the Services to manipulate a poll, vote, review, rating, contest, ranking, election or comparable process.

8.5 The User must not represent to any person that an order placed through the Services will produce a specified result, nor offer or describe such an order as a guaranteed outcome. This clause does not prevent the User from using the Services in the course of providing services to its own clients in accordance with the Terms of Use.

8.6 Where the User places an order on behalf of a client, the User warrants that it holds that client's authority and remains solely responsible to Aubrium in respect of the order.

9. Pages hosted by Aubrium

9.1 Where the Services permit the User to publish a page hosted by Aubrium, the User is the publisher of that page and is responsible for its content and for each destination to which it links, including where that destination redirects.

9.2 The User must not: (a) use a redirect chain or link shortener to disguise a destination; (b) present different content to a visitor, to an automated review and to the crawler of a Social Platform; (c) use a page to obtain credentials, payment details or identity documents otherwise than in the course of a lawful and clearly identified business; (d) use the brand, logo or name of another person in a manner suggesting that they published the page; (e) register handles in bulk, for the purpose of resale, or in a manner which impersonates a person or entity; or (f) use a page to distribute content prohibited by clause 6.

9.3 Aubrium may review any page hosted by it and may take the measures described in clause 11 in respect of it.

10. Features employing artificial intelligence

10.1 The AI Policy governs the use of those features and forms part of the Terms of Use.

10.2 Without limiting the AI Policy, the User must not use such a feature to generate content prohibited by clause 6, to impersonate a real person, to produce material presented as a real event which did not occur, to generate content at volume for unsolicited or coordinated inauthentic activity, or to circumvent a safety control.

11. Monitoring and enforcement

11.1 Aubrium may monitor use of the Services for the purpose of verifying compliance with this Policy and may investigate any suspected breach. Aubrium is under no general obligation to monitor content, and the exercise of a right under this clause does not give rise to any duty to do so.

11.2 Where Aubrium determines that a breach has occurred, or reasonably suspects that a breach has occurred, it may take one or more of the following measures: issue a warning; require the User to remedy the breach within a stated period; remove or disable access to content; restrict a feature, the ability to add funds, or the ability to place further orders; cancel an order; suspend the Account; terminate the Account; and decline to provide the Services to the same person in the future.

11.3 Aubrium selects the measure which it considers proportionate, having regard to the seriousness of the breach, whether it was deliberate, whether it is continuing, the risk of harm to any person, and the history of the Account.

11.4 Aubrium may act without prior notice where the breach involves unlawful activity, a risk of imminent harm, active fraud, or a risk to the security or availability of the Services.

11.5 Where an order is cancelled under this clause, the Fee is refunded to the Balance, except where the order was placed in breach of clause 8.

11.6 A breach of this Policy is a breach of the Terms of Use. The User remains liable for any Fee incurred before the taking of a measure under this clause, and for any cost, loss or liability incurred by Aubrium as a consequence of the breach, in accordance with the indemnity in the Terms of Use.

12. Reports and complaints

12.1 Content or conduct which breaches this Policy may be reported to legal [at] aubrium.com, stating the account, page or content concerned, the grounds of the complaint, and any supporting evidence.

12.2 A complaint that content infringes an intellectual property right should identify the right relied upon and the basis on which it is held, identify the content complained of by reference to its location, and include a statement that the complainant holds a good faith belief that the use complained of is not authorised by the rights holder, its agent or the law, that the information given is accurate, and that the complainant is the rights holder or is authorised to act on its behalf.

12.3 Where content is removed following a complaint, Aubrium notifies the User who submitted it, provides the substance of the complaint, and affords that User an opportunity to respond. Where a response is received which discloses a genuine dispute as to entitlement, Aubrium may restore the content and leave the dispute to be resolved between the parties.

12.4 Aubrium acknowledges a report within two (2) business days and prioritises reports concerning minors, imminent harm and active fraud.

12.5 Aubrium may decline a report which is incomplete, which is directed at lawful criticism, review, comparison or parody, or which appears to be made in bad faith or for the purpose of suppressing lawful expression or a competitor. Aubrium may decline to accept further reports from a source which has repeatedly submitted reports in bad faith.

12.6 An Account against which repeated well-founded complaints of infringement are recorded may be terminated.

13. Review of enforcement decisions

13.1 A User affected by a measure taken under clause 11 may request a review by writing to support [at] aubrium.com within thirty (30) days of the measure, stating the grounds upon which the decision is said to be wrong.

13.2 A review is conducted by a person who was not involved in the original decision. Aubrium aims to respond within ten (10) business days.

13.3 Aubrium may decline to review a request which does not engage with the reasons given for the decision, and may decline further correspondence following a final decision.

13.4 This clause does not affect any right to bring a complaint before a competent authority or court.

14. Circumvention of enforcement

14.1 The User must not: (a) register a further Account following suspension or termination; (b) use an alternative Account, identity, email address or payment instrument in order to evade a measure taken under clause 11; or (c) bypass or attempt to bypass any technical or administrative restriction imposed under this Policy.

14.2 A breach of clause 14.1 constitutes a material breach of the Terms of Use and will be treated as a serious breach for the purposes of clause 11.3.

15. Cooperation with third parties and authorities

15.1 Aubrium may cooperate with payment providers, card schemes, infrastructure providers, Social Platforms and law enforcement, and may disclose information relating to a breach, where required by applicable law or where reasonably necessary in order to prevent fraud, to protect the Services, or to comply with the rules of a payment scheme.

15.2 Aubrium discloses only such information as is necessary for that purpose and maintains a record of each disclosure.

15.3 Aubrium is under no obligation to notify a User of a disclosure made under this clause where notification is not required by applicable law.

16. Amendment

16.1 Aubrium may amend this Policy from time to time in order to reflect a change in applicable law, in the operation of the Services, or in its risk management practices. An amendment takes effect upon publication.
